PETITION FOR THE INCORPORATION OF THE TOWN OF BERLIN ALABAMA

Petition for the Incorporation of the Town of Berlin, Alabama, filed and made Court record the 21st day of August, 2017, by Patrick Bates, by and through Attorney, Heath E. Meherg.

Notice of Compliance published for three successive weeks in a newspaper of general circulation.

All interested parties were provided 30 days from the date of last publication within which to file a written objection to the application with the Judge of Probate. No objections were filed with the Judge of Probate and the Notice of Compliance was granted September 22, 2017, by the Honorable Tammy Brown, Judge of Probate, desiring that the unincorporated community become organized as a municipal corporation.

And it appearing to the satisfaction of the Court that the territory which is proposed to be incorporated is within said County and State and has met the requirements by Alabama Code §11-41-1. Order of Election was granted the 21st day of December, 2017, by the Honorable Tammy Brown, Judge of Probate, and therefore Notice of Election was granted the same, it is therefore ORDERED as follows:

ELECTION for INCORPORATION of the TOWN OF BERLIN, ALABAMA, SHALL BE HELD: February 13, 2017, Tuesday

Cullman, AL 35055

VOTING HOURS: 7:00 a.m. to 7:00 p.m.

THREE (3) QUALIFIED ELECTORS RESIDING WITHIN SAID TERRITORY PROPOSED TO BE INCORPORATED:
Tony Duke, Inspector
Marie Sanford, Inspector
Mary Sue Freeman, Inspector

Any person who is a qualified elector/voter under the State Law and has resided within the boundaries of the said territory proposed for three (3) months next preceding may vote at such election.

Within five (5) days after the election, the inspectors must certify the result to the judge of probate pursuant to Alabama Code 11-41-4.
