Fortners Aggravated Child Abuse Charge Follows Childs Death

Cullman e911 dispatched deputies from the Cullman County Sheriff’s Office (CCSO) to an address in Holly Pond on February 23, 2018.

The call was in regards to the death of a juvenile at the child’s home.

According to the Cullman County Sheriff’s Office:

“After arriving on the scene, deputies determined that the condition and environment of the home were unsanitary due to filth and neglect, which appeared to have accumulated over a long period of time.”

As a result of the investigation, a man and woman have been arrested:

Kenneth Allen Fortner (37)
Jennifer Denise Fortner (37)

Both have been charged with

• Aggravated Child Abuse

Courthouse records show Lieutenant Philip Bray of CCSO filed a complaint, stating in part that both Jennifer and Kenneth Fortner:

“… did torture, willfully abuse, cruelly beat or otherwise willfully maltreat the said child by. to-wit: ON NUMEROUS OCCASIONS FAILED TO PROVIDE ADEQUATE FOOD AND/OR CARE RESULTING IN OPEN WOUNDS, MALNOURISHMENT AND/OR EMACIATION LEADING TO DEATH.”

The Sheriff’s Office said they do not know the exact cause or manner of the child’s death.

The Alabama Department of Forensic Sciences in Huntsville will conduct an autopsy

The Fortners are in the Cullman County Detention Center; both have $50,000 cash bonds that have not been fulfilled at the time of this report.

They remain in jail.
