1st DEGREE RAPE + SEXUAL EXTORTION CHARGES

The Cullman County Sheriff’s Office (CCSO) announced this afternoon the results of a weeks-long investigation that resulted in a search warrant execution.

The investigation surrounded the possibility a suspect had abused a minor child.

CCSO Investigators executed the warrant on Monday (August 14, 2018).

They arrested:

FRANCISCO JAVIER MARTINEZ (26) of Hanceville

Martinez has been charged with

• Rape – 1st Degree
• Sexual Extortion

Due to the graphic nature of the alleged crimes in conjunction with the involvement of minor children, CCSO can provide only limited details on the case.

The Alabama Code Title 13A Criminal Code § 13A-6-241 defines Sexual Extortion as:

(a) A person commits the crime of sexual extortion, if he or she knowingly causes another person to engage in sexual intercourse, deviate sexual intercourse, sexual contact, or in a sexual act or to produce any photograph, digital image, video, film, or other recording of any person, whether recognizable or not, engaged in any act of sadomasochistic abuse, sexual intercourse, deviate sexual intercourse, sexual excitement, masturbation, breast nudity, genital nudity, or other sexual conduct by transmitting any communication containing any threat to injure the body, property, or reputation of any person.

(b) Sexual extortion is a Class B felony.

Sheriff Matt Gentry had these thoughts:

“I have said this many times – but – anytime children are victims of a crime it will break your heart and also make you angry at the same time.

 

I am thankful we at the Sheriff’s office have two investigators who are dedicated to working ‘crimes against persons’. I truly believe that is why the community is seeing so many of these type of arrests and cases being solved.

 

We would also like the think the Child Advocacy Center (CAC) and the Department of Human Resources (DHR) for their help when we have cases involving children.” 

Martinex is apparently in trouble elsewhere with the law.

The U.S. Immigration and Customs Enforcement (ICE) agency has delivered a detainer paperwork to CCSO.

As a result, if Martinez’s charges are satisfied – or – he attempts to make bond, ICE has the discretion to take him into federal custody.

Martinez is currently being held in the Cullman County Detention Center on a $35,000 bond.
